These terms and
conditions of use expressly regulate the
relationships established between Adaptative Learning,
SL (hereinafter Adaptative )
and any user (hereinafter the User or Users )
who downloads and uses the Snackson Application
(hereinafter the Application or Snackson )
.
The relationship
established between the User and Adaptative is
understood as one of these options:
OPTION 1.
BUSINESS ENVIRONMENTS
By installing Snackson , the User accepts these terms and conditions of use:
Snackson is a microlearning application, owned by Adaptative , which offers a service based on the distribution of small contents or microcontents organized into temporary challenges that seek the acquisition of knowledge by the User . The User receives the content and is awarded points for viewing it or for correctly answering the questions posed in the challenge.
Snackson can
be used both in its web version (modern browsers)
and in its Android and IOS version.
Adaptative offers a free, non-exclusive, worldwide, revocable license to use the Snackson application within the limits established by these terms and conditions.
The download of Snackson is free for the User for his personal and non-commercial use. Adaptative reserves the right to modify or disable Snackson at any time and for any reason.
In order to be a Snackson User , it is essential that the following requirements be met:

can be done in two ways:
In the case of access by fixed password, the User agrees to use all the necessary measures to protect their access code, specifically the User agrees to:
Adaptative cannot
guarantee the identity of Registered Users,
therefore, it will not be responsible for the use of
the identity of a Registered User by unregistered
third parties. The User agrees to
immediately notify Adaptative of
the theft, disclosure or loss of their username or
password, notifying info@snackson.com.
The user cannot
modify their own data within the application. You can always
request the CLIENT or ADAPTATIVE to modify and/or
delete them . It must be taken
into account that many of the training initiatives
that are carried out are of a mandatory nature for
the user due to their contractual relationship with
the Client, with which it is the Client in the last
instance who has to evaluate the adequacy or not of
the withdrawal request.
The User must download the Application (IOS / ANDROID) or access via the web (https://entrar.snackson.com/) and choose the navigation language from the available options.
Once registered in the Application, the User will have access to the microcourses and will be able to participate in the learning dynamics that the Client or Adaptative have made available to them.
The User can participate in several microcourses in parallel. The User will receive notifications through the Application each time a new microcontent ( learning objects ) arrives. These objects can be informative (text, image, video...) or evaluative (questions).
A microcourse can be organized individually or in groups. When the User views content or correctly answers a question, they can earn points that are added to both the challenge ranking and the personal ranking.
The Application has
a notification system
that notifies the User if there is new content or if
they have won a prize or a badge. It also has
internal communication tools (Chat and forum), if
the Client enables it.
The badges constitute a distinctive emblem awarded by Snackson according to a series of scoring criteria that the User achieves.
The prizes will be defined and awarded at the Customer 's discretion , not constituting any type of responsibility for Snackson with respect to the allocation criteria, delivery to Users or compliance with tax obligations that may arise.
The Application, in turn, keeps track of the contents displayed and a follow-up of the actions carried out.
The User is fully responsible for the access and correct use of Snackson subject to current legislation, whether national or international, as well as the principles of good faith, morality, good customs and public order. The User is responsible for having the necessary services and equipment for browsing the Internet and for accessing Snackson .
Users will refrain from using Snackson 's services and content for illegal purposes or effects that are harmful to the rights and interests of third parties, or that in any way may damage, disable, affect or deteriorate Snackson , its content and its services. Likewise, it is prohibited to prevent the normal use or enjoyment of Snackson by other Users.
The User undertakes to maintain appropriate and respectful behavior towards other Users. Therefore, including but not limited to, they undertake not to behave in a violent, disrespectful, racist, discriminatory, harassing, intimidating, unhygienic, etc. manner. responding personally to any damage or harm caused to other Users derived from their inappropriate conduct.
In general, the User undertakes, by way of example and not limitation, to:
The User declares to accept and understand that the services are offered "as is", "as available" and "according to availability".
In this sense, Adaptative does not guarantee or assume responsibility for:
In the event of occasional interruptions in Snackson or that Adaptative needs to make maintenance stops, Snackson will not have the obligation to reward the User in any way, it being understood that these are caused by external agents of an exceptional nature that Adaptative cannot control.
Snackson may host Adaptative content as well as other content owned by the Client or third parties. It will be the sole responsibility of the User to consult in each case the permitted uses of each content, and Adaptative cannot be held responsible in any case for the unauthorized use of said content.
Therefore, Adaptative is the owner or licensee of all intellectual and industrial property rights over all content accessible through Snackson . Snackson 's intellectual and industrial property rights , as well as: texts, images, graphic design, navigation structure, information and content contained in it, unless otherwise indicated, are the property of Adaptative, to whom the exercise corresponds . of the rights to exploit them and, in particular, the rights of reproduction, distribution, public communication and transformation, in accordance with Spanish legislation on intellectual and industrial property rights.
Access to Snackson does not imply waiver, transmission, license or total or partial assignment of intellectual or industrial property rights by Adaptative .
Likewise, Adaptative is not obliged to supervise or control the content that the User publishes through Snackson, nor can it be held responsible as long as it does not have effective knowledge that the activity or information stored is illegal or that it damages property or rights of a third.
As part of the services, the User may receive push notifications on his mobile device with a variable frequency, as determined by the Client . In case of not wanting to receive them, it will be the responsibility of the User to deactivate this function from the settings or preferences menu present in their terminal.
In the same way,
the User declares to be informed that the Client or
Adaptative can
use his email account to provide him with
information exclusively referring to Snackson and
linked to the dynamics of the service: content
expiration notice, new courses, access advice. ..
These notices,
whether push or mail, cannot be deactivated in a
particular way and are inherent to the Adaptative
service.
Likewise, Adaptative may send instructions to your email on the process of recovery or modification of the access code.
The user's data, as
well as the courses provided, are managed either by
the CLIENT or
by ADAPTATIVE . If the user does
not know who is responsible for their data, they can
always contact us at hello@snackson.com.
The Client may
terminate the User's account when deemed appropriate
according to the specific conditions established
between the User and the Client.
Likewise, in the event that the User ceases to agree with these Terms and Conditions or wishes to no longer be a Snackson user , they must uninstall the application, and formally contact the Client or Adaptative to request the cancellation of their account.
Adaptative may temporarily deactivate or permanently delete, without prior notice and immediately, the User's account when:
In accordance with current legislation on the Protection of Personal Data, Adaptative informs Snackson Users about the Privacy and Data Protection Policy that it will apply in the processing of personal data that the User provides through access to Snackson .
The User consents to the processing of such data under the terms of this Privacy Policy and Data Protection clause.
Adaptative expresses its commitment to comply with current legislation at all times regarding data protection, specifically with the General Data Protection Regulation (RGPD), of May 25, Organic Law 15/1999, of December 13, Protection of Personal Data; Royal Decree 1720/2007, of December 21, which approves the Regulations for the development of Organic Law 15/1999; and other applicable legislation.
The person in charge of the files is Adaptative Learning, SL with address at C/Llacuna 162, Module 211 (Barcelona Activa) CP 08018 (Barcelona). At this same address, or by sending an email to the Data Protection Delegate: rgpd@snackson.com, Users may exercise their rights of access, rectification, cancellation and opposition of data, by sending a written and signed request including name , surnames, photocopy of the DNI, action requested and address in order to send you confirmation of your action in accordance with your request.
Adaptative Learning will proceed to analyze the request and once the Client is informed, the pertinent actions will be carried out.
Adaptative has adopted the necessary measures to maintain the level of security required, depending on the nature of the personal data processed and the circumstances of the treatment, in order to avoid, as far as possible and always according to the state of the art, its alteration, loss, treatment or unauthorized access. The personal data provided will not be transferred to third parties without prior authorization from the owner thereof.
The fulfillment and interpretation of these Conditions of Use will be carried out in accordance with the provisions of Spanish regulations. In the event of any conflict in relation to these terms and conditions of use, the parties submit, expressly waiving any other jurisdiction, to the Courts of Barcelona.
